LexisNexis Case Analysis: Getty Images (US), Inc. (a company incorporated under the laws of the State of New York) and other companies v Stability AI Ltd [2025] EWCA Civ 749

Legal Director Helene Whelbourn and Trainee Solicitor Saher Amin discuss the Court of Appeal’s decision affirming the High Court ruling as part of the wider legal dispute over the alleged misuse of Getty Images (US), Inc’s content by Stability AI Ltd to train its generative AI model, Stability Diffusion, that child sexual abuse material was explicitly excluded from Getty’s claims and therefore could not be introduced as evidence.

The Court found that Getty’s own pleadings explicitly excluded CSAM-related allegations highlighting the importance of precise pleadings, especially in such complex litigation. Notwithstanding that this case dealt with novel issues and technological context, UK courts will continue to enforce strict procedural boundaries, affirming the importance of upholding high duties of care to court procedure.
