The Court of Appeal dismissed Iceland’s appeal following a decision in the Intellectual Property Enterprise Court to refuse their application for a summary judgment in their counterclaim for invalidity of Babek’s UK trade mark registration. Having reconsidered the issues of the case, the Court concluded that Babek’s mark complied with the conditions for registrability being a single, clear and precise sign.
